How it started

Our client, a boutique search firm, faced a critical issue when a former employee joined a direct competitor in violation of post-termination restrictive covenants. The ex-employee not only breached the contract by working for a competitor but also solicited one of the search firm’s key clients, a prestigious luxury clothing brand. Concerned about the potential damage to their business and relationships, the client turned to Moorcrofts for guidance.

What we did

Moorcrofts acted swiftly to assess the situation. We reviewed the employee’s contract and confirmed that the restrictive covenants were enforceable. Our team crafted a strategic plan and immediately issued a robust cease-and-desist letter to the former employee, outlining the breaches and demanding that they cease all activities that violated their contractual obligations.

At the same time, we provided guidance on how to tactfully approach the new employer, aiming to resolve the situation amicably without resorting to expensive litigation. By taking a practical and commercially focused approach, we aimed to protect our client’s business interests while minimising disruption.
